Terms of Service

By accessing or using the Tracta platform, you agree to be bound by these Terms of Service. If you are using Tracta on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.

If you do not agree to these terms, you may not access or use the platform.

Tracta grants you a limited, non-exclusive, non-transferable licence to access and use the platform for your internal business purposes in accordance with these terms.

The platform is provided as a software-as-a-service. You access it over the internet and do not receive any software installation rights unless separately agreed.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must promptly notify us of any unauthorised access to or use of your account. Tracta is not liable for losses arising from your failure to maintain account security.

Accounts are personal and may not be shared. Each user must have their own credentials. This is particularly important in the context of engineering record attribution, where each action is linked to a named individual.

You agree not to use the platform in any manner that violates applicable laws or regulations, infringes the rights of any third party, or interferes with the integrity or operation of the service.

You must not attempt to gain unauthorised access to any part of the platform, introduce malicious code, or circumvent any security or access controls.

You must not use the platform to store or transmit information that is unlawful, defamatory, or harmful.

The Tracta platform, including its software, design, and documentation, is owned by Tracta and protected by intellectual property law. These terms do not transfer any ownership rights to you.

Your engineering data, documents, and records remain your property. You grant Tracta a limited licence to process and store this data solely for the purpose of delivering the service.

We aim to maintain high availability of the platform but do not guarantee uninterrupted or error-free operation. Planned maintenance will be communicated in advance where reasonably practicable.

We reserve the right to modify or discontinue features of the platform with reasonable notice.

To the fullest extent permitted by law, Tracta is not liable for indirect, incidental, special, or consequential damages arising from your use of the platform, including loss of data, business interruption, or loss of profits.

Our total liability for any claim arising from these terms or your use of the platform is limited to the amounts paid by you in the twelve months preceding the claim.

Either party may terminate the agreement with notice in accordance with your subscription terms. We may suspend or terminate your access immediately if you materially breach these terms.

Upon termination, your access to the platform will cease. We will retain your data for a defined period in accordance with our data retention policy, after which it will be securely deleted.

We may update these Terms of Service from time to time. We will notify you of material changes by email or by a prominent notice within the platform. Continued use of the platform after changes take effect constitutes acceptance of the updated terms.
